§ 1 Animal Welfare Act

The purpose of this Act is to protect the life and well-being of animals as fellow creatures, based on human responsibility for them. No one may inflict pain, suffering or harm on an animal without reasonable cause.

The legal duty of cities

Cities are responsible for feral domestic pigeons as former farm animals. Section 1 of the Animal Welfare Act requires species-appropriate care and avoidance of suffering (starvation = suffering).
City pigeons are not wildlife but abandoned pets and their descendants
Killing and displacement is unlawful
Municipalities must implement animal-welfare measures (such as pigeon lofts)
Without an alternative solution, feeding bans alone are not sufficient

"Disease carriers" debunked

City pigeons do not transmit relevant diseases to humans, unlike dogs, cats or ducks
